Ways We Can Help
Premarital Agreements
Marriage is the most important decision that any of us will make in our lives. It is extremely easy to enter into, and very difficult to exit without severe emotional, family, and financial consequences. Marriage is a legal construct that most young people enter into without understanding the legal and financial burdens that go along with a failed marriage - burdens that seem out of sight and out of mind when they are in love. Most of us think that "divorce can't happen to us," but believe me, a quick glance at the divorce statistics in this country makes it clear that it can happen to you.
Does this mean that you shouldn't marry the man or woman that you love? Of course not. Love and marriage are not dead, but there is a way to chart a safer course. Premarital agreements can be a safeguard for the future and provide you with a proactive approach to managing your financial and legal affairs before marriage. These agreements can foster open communication, strengthen the foundation of trust and transparency in your relationship, and protect both partners' interests. Most importantly, this can be done when both of you still love each other and want your marriage to succeed.
If you have been on the losing end of a divorce already, let me first say that I'm sorry and I now the pain that you have gone through. However, the good news is that since you are here, you are ready to give marriage another try. There is no better way to get your next adventure off to the best start possible than by making sure your financial and legal affairs are properly protected before you marry again.
Now that you see all the benefits a premarital agreement can provide, set up a consultation with me and we can discuss your current and future financial situation, your goals, and together we can craft a premarital agreement that will be binding and will help lay the foundation for a successful marriage.
Dividing Your 401(k) / IRA
During a divorce, one of the items that you may have to deal with is dividing your 401(k) or IRA with your husband or wife. This is accomplished through a motion called a Qualified Domestic Relations Order ("QDRO"). A 401(k) QDRO can be complicated, and it is likely that your divorce attorney may not want to make this motion as part of the services he or she is providing to you in connection with your divorce. I am happy to step in and perform this function. Set up a consultation with me, and we can discuss your personal situation.
If you are a divorce attorney and are interested in outsourcing the 401(k) QDRO portion of your client's divorce, I will work diligently with your client and the opposing party to make dividing their 401(k) as painless and quick as possible. Feel free to schedule time with me to discuss referring your clients to me for this service.
